The ductal carcinoma in situ (DCIS) Score quantifies the risk of ipsilateral breast event (IBE) and invasive IBE risk, complements both traditional clinical and pathologic factors, and helps provide a new clinical tool to improve the process of selecting individualized treatment for women with DCIS who meet the criteria, according to a study published May 2 in the Journal of the National Cancer Institute.

Most women with newly diagnosed cases of DCIS are eligible for breast conservation surgery, either with radiation treatment or without. The risk of developing IBE after surgical excision without radiation has not been well defined by clinical and pathological characteristics for women with DCIS.

In order to determine the risk of developing IBE after surgical expression without radiation for women with DCIS, Lawrence J. Solin, M.D., of the Department of Radiation Oncology at the Albert Einstein Medical Center in Philadelphia and colleagues looked at the Oncotype DX breast cancer assay which was used for patients with DCIS, treated with surgical excision without radiation in the Eastern Cooperative Oncology Group (ECOG) E5194 study, and looked at the association between the DCIS Score and the risk of developing IBE.

The researchers found that the continuous DCIS Score was statistically significantly associated with the risk of developing IBE. "The DCIS Score predicts the risks of local recurrence and invasive local recurrence and provides information that complements traditional clinical and pathologic factors for this study population of women with DCIS treated with surgical excision without radiation."

In an accompanying editorial, Christine D. Berg, M.D., formerly of the National Cancer Institute, writes that the assay does appear to be a step forward, but there were limitations, including that it was tested in a selected subset of patients. "The clinical applicability of this assay for all women who present with DCIS remains to be determined as the research was done on a highly selected patient group."

In another editorial, Thomas B. Julian, M.D., of Allegheny General Hospital in Pittsburgh, writes that the study and team should be applauded for efforts in introducing the DCIS score with an attempt to validate risk recurrence in patients with DCIS using tumor genetic profiling. "The DCIS Score should complement traditional clinical and pathologic factors used to guide decision making in the treatment of DCIS."

Chael Sonnen not retiring, eyes Wanderlei Silva

Chael Sonnen's loss to Jon Jones at UFC 159 put his career in question. At 36 years old, and with title losses in two different divisions, would Sonnen consider retiring? He answered that question on Fuel's "UFC Tonight," and that answer is no.

"I have a lot of goals I want to achieve still, and retirement won't help me get that done," Sonnen said.

He said the weight class is up for debate, though he liked the switch to light heavyweight after years as a middleweight. He would also be happy to fight at a catchweight, like Rich Franklin did for a few fights when moving up in weight. But there's no question about who he wants to fight.

"I'm not going anywhere until me and Wanderlei [Silva] straighten this thing out once and for all,"

Like Sonnen, Silva has moved between middleweight, light heavyweight and catchweights somewhere between. He is also 36, but the sensible match-up isn't why Sonnen is interested in this bout. Sonnen has a problem with this video from 2010:

Here is how Sonnen viewed this video.

"Wanderlei pulled a really dirtbag move on me one time. We're in a van, he mutters something at me, I can't understand what he's saying. He then puts it on YouTube with subtitles because he knows I can't understand him. He puts in these subtitles and I don't know if it's what he's said or not. Essentially, he tells me off, and it looks as though I'm conceding to him. That doesn't fly. If he calls you out, whether it's in a van or not, if you're a fighter, you must respond. I'm ready to respond."

Silva responded by tweeting this:

And then sharing the above video and saying, "Real men talk face to face."

Is this a fight you want to see, Cagereaders? Speak up on Facebook or Twitter.

Tests link deadly ricin to Obama letter suspect

TUPELO, Miss. (AP) ? Ricin was found in the former martial arts studio of the man suspected of sending poison letters to President Barack Obama and other public officials, and was also discovered on a dust mask and other items he threw in the trash, federal prosecutors said in a court document made public Tuesday.

The affidavit says an FBI surveillance team saw James Everett Dutschke remove several items from the studio in Tupelo, Miss., on April 22 and dump them in a trash bin about 100 yards down the street. The items included a dust mask that later tested positive for ricin, the affidavit said.

Traces of ricin also were found in the studio and Dutschke used the Internet to buy castor beans, from which ricin is derived, the affidavit said.

Annette Dobbs, who owns the small shopping center where the studio was located, said authorities padlocked the door to it sometime the search. She said Tuesday that FBI agents haven't told her anything, including whether the building poses a health threat. Inside the studio is one large room with a smaller reception area and a concrete floor. Police tape covered the front and the small back door.

Dutschke, 41, was arrested Saturday by FBI agents at his home in Tupelo, and is being held without bond pending a preliminary and detention hearing Thursday in U.S. District Court in Oxford.

The FBI searched his home, vehicles and studio last week, often while wearing hazardous materials suits. Attention turned to Dutschke after prosecutors dropped charges against an Elvis impersonator who says he had feuded with Dutschke in the past.

Dutschke told The Associated Press last week that he didn't send the letters. His lawyer, federal public defender George Lucas, had no comment Tuesday about the information in the affidavit.

Dutschke was arrested as part of the investigation into poison-tainted letters sent to Obama, U.S. Sen. Roger Wicker and Lee County, Miss., Judge Sadie Holland.

The affidavit said numerous documents found in Dutschke's home had "trashmarks" that were similar to ones on the letters sent to the officials.

"Trashmarks are flaws or marks that come from dirt, scratches, or other marks on the printer. They are transferred to each piece of paper that is run through the printer," it said.

It also describes text messages allegedly sent between two phones subscribed to Dutschke's wife, including one on April 20 that said "get a fire going" and "we're coming over to burn some things."

The FBI has not yet revealed details about how lethal the ricin was. A Senate official has said the ricin was not weaponized, meaning it wasn't in a form that could easily enter the body. If inhaled, ricin can cause respiratory failure, among other symptoms. No antidote exists.

The most notable case of ricin poisoning was in 1978, when a Bulgarian dissident was lethally injected with it by an operative of that country's secret service.

Dutschke also bought 50 castor beans off eBay in November 2012 and 50 more in December 2012, the affidavit said.

The affidavit had been sealed since it was filed Friday in U.S. District Court in Oxford. It also said that on evening of Dec. 31, 2012, someone using his "computer downloaded a publication, Standard Operating Procedure for Ricin, which describes safe handling and storage methods for ricin, and approximately two hours later, Immunochromotography Detection of Ricin in Environmental and Biological Samples, which describes a method for detecting ricin."

An expert at the National Bioforensics Analysis Center in Fort Detrick, Md., said the extraction process employed in this case appears to have been more involved than "merely grinding castor beans," the affidavit said.

A witness, who is not named in the document, told investigators that Dutschke once said years ago that he knows how to make poison that could be sent to elected officials and "whoever opened these envelopes containing the poison would die."

Judge Holland dismissed a civil suit that Dutschke filed in 2006 against the witness, who accused him of making sexual advances toward the witness' daughter, the affidavit said. In April, Dutschke pleaded not guilty in state court to two child molestation charges involving three girls younger than 16. He also was appealing a conviction on a different charge of indecent exposure. He told AP that his lawyer told him not to comment on those cases.

The lawsuit isn't Dutschke's only connection to Holland. She is part of a family that has had political skirmishes with him.

Her son, Steve Holland, a Democratic state representative, said his mother encountered Dutschke at a rally in the town of Verona in 2007, when Dutschke ran as a Republican against Steve Holland.

Holland said his mother confronted Dutschke after he made a derogatory speech about the Holland family. She demanded that he apologize, which Holland says he did.

Dutschke's MySpace page has several pictures with him and Wicker. Republicans in north Mississippi say Dutschke used to frequently show up at GOP events and mingle with people, usually finding a way to get a snapshot of himself with the headliner.

The first suspect accused by the FBI, Paul Kevin Curtis, 45, also had also had ties to Holland. Curtis was arrested on April 17 at his Corinth, Miss., home, but the charges were dropped six days later. After his arrest, Curtis said he was framed and gave investigators Dutschke's name as someone who could have sent the letters, the affidavit said.

Some of the language in the letters was similar to posts on Curtis' Facebook page and they were signed, "I am KC and I approve this message." Curtis often used a similar online signoff.

Curtis has said he knows Dutschke and they feuded over the years, but he wasn't sure what caused it.

Dutschke made a brief appearance Monday in federal court, wearing an orange jumpsuit with his hands shackled. He said little during the hearing other than answering affirmatively to the judge's questions about whether he understood the charges against him. U.S. Magistrate S. Allan Alexander set his preliminary and detention hearing to take place Thursday.

He faces up to life in prison if convicted.

ATLANTA (AP) - Atlanta Mayor Kasim Reed has announced the city hosted more than 40 million visitors last year, and the record puts Atlanta on par with Los Angeles, Las Vegas and San Diego.

Reed made the announcement during a press conference Tuesday afternoon, and said tourism is 1 of Atlanta's primary economic drivers.

City officials say visitation has increased by 28% in the last decade while the city charted a $5 billion increase in new attractions, restaurants and hotels.

The city's hospitality industry is set to continue growing as $2.5 billion in development has been planned through 2017. Officials say the industry supports more than 223,000 jobs in Atlanta, and translates to an annual impact of about $12 billion.

Andreessen: Android poised to explode in emerging markets

Marc Andressen on Bloomberg

Bloomberg recently TV interviewed Marc Andreessen, the guy who’s famous for co-founding Netscape and currently works as a VC at his own Silicon Valley VC shop, Andreessen Horowitz.

Towards the end of the interview, he was asked what’s big for 2013. After saying that tablet growth would still be huge, he followed up with this quote:

"The other thing I think I'd point to is the $50 Android smartphone is about to hit the market worldwide. Smartphones are about to be put in the hands of another 3 billion people who don't have them. And that's probably the single biggest thing that's happening right now."

In the developed world, we tend to think of Android as Samsung Galaxy S3 and S4, the new HTC One, maybe some Sony, and throw Motorola in for good measure. Yeah, we hear about cheaper hardware, but rarely do we stop to think about what it means to emerging markets.

What is your Gym, Health, of Fitness Club Worth? How to Value Gym ...

A.???????? Nature of the Business

?

Health clubs, fitness/recreation centers, and gyms provide equipment and exercise rooms used for individuals interested in improving their health and athletic ability.?? IBISWorld reported in February of 2013 that there are over 29,501 gyms, health and fitness clubs in the US market with $26 billion in revenue. The industry?s has annual growth at 1.4% from 200-2013 and employs over 573,000 persons. IBISWorld also reported that the demand for gyms and health centers will to continue to rise over the next five years as the public becomes increasingly health-conscious.

Within the industry, there are different types of gyms.? The most common gyms are the franchised gyms .? These generalized gyms can offer a variety of fitness related amenities that include:

?

  • Fitness machines
  • Free-weights
  • Cardio machines
  • Fitness classes
  • Swimming pools
  • Racquet ball courts
  • Kids club
  • Steam and/or sauna rooms
  • Locker rooms

?

?

The latest trend in the industry is the establishment of microgyms. Some examples include mixed martial arts and Jiu-Jitsu.? Microgyms are different because they offer a more specialized workout that encompasses one or two types of training. These gyms typically offer programs that are built around weightlifting, intervals, and circuit training.

?

The majority of revenue for fitness centers is generated through membership fees.? The fees can be charged on a month-to-month basis, annually, or long-term membership contracts.? Some fitness centers also require a down payment or activation fee to become a member of the club. Fitness centers also generate profits by providing additional amenities, which include personal training sessions, fitness classes, swimming pools, courts, etc.

?

B.???????? Industry

?

In June of 2011, IBISWorld analyzed 33,385 fitness centers and found the industry costs had percentages equal to a profit of 8.0%, rent of 12.0%, utilities of 3.5%, depreciation of 7.5%, wages of 29.6%, purchases of 20.0%, and ?other? totaling 19.4%.

?

C.???????? Facility / Employees

?

The facility will depend, to a certain extent, on the type of gym.? A franchised gym may need to construct a new building, using plans provided by the franchise.? Independent or privately owned gyms have the option of leasing or purchasing a building that has enough open floor space for the business.? The amount of space needed can be determined by the niche market and the amount of equipment the business will offer.

?

The staff required to operate a fitness center generally involves an array of employees.? Employees may include: reception staff, maintenance and cleaning staff, personal trainers, managers, and/or dieticians.? Depending on the location and sport (e.g.Jiu-Jitsu)of the fitness center, personal trainers and fitness instructors may need to be licensed.? Since this is a service-based industry, staffing experienced and well-trained employees is an important factor to retaining existing customers and securing new customers through referrals.

?

D.???????? Equipment

?

The equipment will vary from gym to gym.? Gyms that are catering to a wide audience will either lease or purchase the equipment.? Leasing the equipment may help the business stay up-to-date with the ever changing technology in this industry.? Niche gyms should consider equipment for their specific needs.? For example, a boxing gym will need punching bags, boxing gloves, boxing ring(s) and protective equipment.? A gym that offers CrossFit may need different specialized equipment such as an Olympic weight set, kettlebells, climbing ropes, plyo boxes, jump ropes, and/or sets of rings.

?

Typically, gyms have a reception area and locker rooms that will need to be furnished.? A clean and sanitized facility is important to the industry. Most fitness centers will need a variety of cleaning supplies which can include towels, sanitizing sprays, paper towels, etc.

?

Franchised gyms usually require the owner to have a net worth benchmark in order to get the gym built, equipped, staffed and running through its first year.? Franchised gyms can have pre-planned layouts and pre-selected equipment for a franchised owner, insuring that each gym is held up to the franchises? standards and is consistent with other franchise locations.

?

E.???????? Income and Expense Pro Forma ? The following is general information regarding the ?????? profit / loss of the business.

?

$2 million to $10 million ? Fitness and Recreational Sports Centers (NAICS #713940)1

?

  1. Net Sales????????????????????????? 100%
  2. Operating Expenses??????? 89.3%
  3. Operating Profit?????????????? 10.7%
  4. All Other Expense (net)???? 6.4%
  5. Profit Before Taxes??????????? 4.3%

?

1 RMA Annual Statement Studies 2012-2013. (Philadelphia: RMA, 2012), p.1574-1575.

?

F.???????? Valuation (Not All Inclusive)

?

  1. Cost Method:
    1. Generally also known as the Asset-Based Approach, the Cost Approach values a company by determining what proceeds can be derived from selling off assets, less the cost of satisfying liabilities. This approach determines a company?s value by analyzing the market value of a company?s assets.? Many times this serves as a valuation floor since most companies have greater value as a going concern than they would if liquidated.

?

  1. Income-Capitalization Method:
    1. Discounted Cash Flow Method/Earnings Method/Capitalization Approach:???? The worth of a company is based on the earnings or cash flow that the company can generate in the future for the benefit of its stockholders/owners. These protected earnings are discounted to present value, which includes the terminal value of the business.
    2. Excess Earnings Plus Adjusted Book Value Approach: This method relies on the historical earnings performance of a company.? Generally, excess income is capitalized to determine Goodwill.? The Goodwill in addition to the adjusted book value of the net assets can be used to approximate the worth of a company.
    3. EBITDA Approach / Value Over Costs?: This approach is short for ?Earnings Before Interest, Taxes, Depreciation and Amortization?.? This method is used to determine how much money a company is making before taxes, depreciation, and amortization have been deducted.? Then, EBITDA is multiplied by the inverse of the appropriate capitalization rate to determine value of the company.

?

  1. Market Method:
    1. Guideline Company Approach : Under this approach, the fair market value of the business is determined by comparing the sales data of private companies sold, i.e. have the same standard industry classification code (SIC Code). This approach may be less effective for the valuation of a closely held business if adequate data is not available.

?

Rules of Thumb: The rules of thumb for remediation companies vary based on numerous factors.? Please contact Zamucen & Curren at (949) 955-2522 for applicable rules of thumb.
